Terms of Service

These terms govern your use of mochacidal.com (the "Site"), operated by Mochacidal Industries, LLC ("Mochacidal", "we", "us"). By using the Site you agree to them. If you do not, please stop using the Site.

Our products have their own terms

The Site is a marketing and information site. The products it links to are separate services with separate agreements, and those agreements govern your use of them:

  • NanoGenesis — the game at nanogenesis.mochacidal.com has its own terms of service and privacy policy, served from that domain.
  • MochaFlux — the platform at flux.mochacidal.com is governed by the agreement presented when you sign up.
  • Client work — anything we build for you under a statement of work is governed by that statement of work, not by these terms.

Where these terms conflict with a product's own terms, the product's terms win for that product.

Use of the Site

You may read, link to and quote the Site for any lawful purpose. You may not:

  • use the Site in a way that breaks the law or infringes anyone's rights;
  • attempt to gain unauthorised access to the Site, its hosting, or any connected system;
  • scrape or copy the Site at a volume that degrades it for other visitors, or use it to train models without our written permission;
  • misrepresent your relationship with us, or use our name or logo in a way that suggests endorsement you do not have.

Content and intellectual property

The text, design, code, logo and imagery on the Site are owned by Mochacidal Industries, LLC unless stated otherwise, and are protected by copyright and trademark law. Nothing in these terms transfers ownership to you.

You may quote short excerpts with attribution and a link. Republishing substantial portions, or reusing our brand assets, requires written permission — ask at tech@mochacidal.com.

Information on the Site is not advice

Articles, guides and technical notes on the Site are provided for general information. They are written from our own experience and may not apply to your systems, your data or your jurisdiction. They are not professional, legal, financial or security advice, and you should not rely on them as a substitute for engaging someone to look at your actual situation.

Enquiries and the contact form

Submitting the contact form or emailing us does not create a client relationship, a contract, or any obligation on our part to provide services. Work begins only under a signed statement of work.

Do not send confidential material, credentials, personal data or regulated information through the contact form. It is monitored by a third-party form service and is not an appropriate channel for anything sensitive.

Third-party links and services

The Site links to services we do not control, including our own product subdomains, Stripe, and product sites. We are not responsible for their content, availability or practices. Follow those links at your own risk and read their terms.

Availability

We aim to keep the Site available but do not guarantee it. We may change, move or withdraw any part of it — including pages, products and download links — at any time and without notice. The Site is provided on an "as is" and "as available" basis.

Disclaimers

To the maximum extent permitted by law, we exclude all warranties, express or implied, relating to the Site, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site is free of errors, viruses or other harmful components.

Limitation of liability

To the maximum extent permitted by law, Mochacidal Industries, LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to your use of the Site — even if we have been advised that such damage is possible.

Where liability cannot be excluded, our total aggregate liability relating to the Site is limited to one hundred US dollars (USD 100).

Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be limited.

Indemnity

You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Site or your breach of these terms.

Privacy

Our privacy policy explains what we collect and why. It forms part of these terms.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. The state and federal courts located in Washington have exclusive jurisdiction over any dispute arising from them, and you consent to that jurisdiction.

Changes to these terms

We may update these terms from time to time. The "last updated" date at the top of this page will change, and continued use of the Site after that date means you accept the revised terms. Material changes will be called out on this page.
